Once beloved comedian Bill Cosby, 83, will be seeing freedom sooner than most expected as Pennyslvania’s highest court has overturned his sexual assault conviction.

Cosby’s conviction was overturned on Wednesday after it was found that an agreement he had made with a previous prosecutor prevented him from being prosecuted.

Known for family-friendly television shows like ‘The Cosby Show’ and ‘Fat Albert,’ Cosby was charged in 2015 with the drugging and raping Andrea Constand.

I hope there is no campaign to rehabilitate his reputation, particularly by attacking his accusers.

What agreement? And why is it just now being discovered? That said, I suspect his time in prisoned had some sort of affect on him.

For the reasons detailed below, we hold that, when a prosecutor makes an unconditional promise of non-prosecution, and when the defendant relies upon that guarantee to the detriment of his constitutional right not to testify, the principle of fundamental fairness that undergirds due process of law in our criminal justice system demands that the promise be enforced.

It’s Fifth Amendment-based. For the full decision you can go here(LINK).

Yeah, why and how is this coming up now and not when he was convicted?

The trial judge and court of appeals rejected that argument. The Pennsylvania Supreme Court accepted it. Actually, it’s a good, solid legal argument on Fifth Amendment grounds, IHMO.
