Three of the six signs on display include the F-bomb, and one features a photo of Donald Trump raising both middle fingers.
The mayor said property is close to a nearby elementary school, and parents were angered by the inappropriate language on the banners.
“The real problem is, from a neighbor perspective, is it’s a block away from an elementary school. It’s in a high visibility area for children. Most of the ire was drawn from a lot of local parents,” he told NJ Advance Media on Tuesday.Roselle Park Municipal Court Judge Gary Bundy ruled “We just had the National Spelling Bee. That word was not one of the words that the kids spell out.”
Alexander Shalom, senior supervising attorney at the American Civil Liberties Union of New Jersey, sided with the homeowner, saying her flags are political speech protected under the Constitution.
The homeowner’s lawyer Michael Campagna likened the decision to Nazi Germany.
“In Nazi Germany, when Hitler didn’t like something, they burned the books and then they burned the people,” Campagna said, according to published reports. “I don’t think we want that to happen in Roselle Park.”The homeowner has 20 days to appeal the decision to Superior Court.

Thomas Healy, a law professor at Seton Hall University with expertise in constitutional issues, disagreed with the judge’s decision.
Citing a 1971 Supreme Court decision, Cohen v. California, that turned on the question of whether the same word at issue in this case was obscene, Healy said the word clearly did not qualify as obscene speech in the context of the political banners.“It’s hard to imagine a simpler case from a constitutional standpoint,” he said, adding that he would be “stunned” if Bundy’s ruling were upheld.
Conflicts like the one have flared up this year on Long Island, New York; in Indiana, Tennessee and Connecticut; and about a half-hour’s drive south of Roselle Park, in Hazlet, New Jersey.
Hazlet officials received complaints like those in Roselle Park when a homeowner put up a similar anti-Biden banner there, Mayor Tara Clark said.
Citing an anti-nuisance ordinance, Clark said, officials approached the homeowner last month and asked that he remove the offending flag, but they did not take any steps to force him to do so.“We knew that there were residents who were upset,” she said. “but we also know that free speech is protected under the Constitution of the United States.”

I’m not sure where I stand on this. On the one hand, I’m pretty sure some people in the past have used the F-word on signs at protests and marches. Maybe directed at Bush or Trump. For some reason, that doesn’t seem so bad.
On the other hand, perhaps the homeowner should have, or could have used asterisks — F**K Biden. I think that would be a fair compromise. I’m curious of the outcome if she takes this to a higher court.

It is their right to put up such a sign. It may be unethical for a number of reasons – but it is still free speech. This is absolutely covered by the first amendment. If it had been put up in a school yard, that would be different.
The mayor and the concerned parents… their opinions are irrelevant in regards to this. They can put up whatever signs they please on their own property.

After reading the comments, reading other articles on this, and watching the video, I feel both sides make a good argument. But in one town the judge did not fine the guy. I think a $250-a-day fine over foul language is way too steep. I also think we haven’t heard the last of this.
IMO, the woman is angry over the election, and if she was anywhere near the Capitol on January 6, she would have been charging inside with the rest of them.

I remember when my employer told me back in 2008 that I had to take the Obama bumper sticker off of my car, and I just fished out my ACLU membership card and showed it to him. Then I told him to please fire me for that and I would retire off of the punitive damages(it was a local government agency, not Cuyahoga County). I got total capitulation.
My question is always, If you deny this one person the right to free political expression, where does it stop? The First Amendment is there for a reason.
