      SCOTUS has ruled NY Governor Cuomo cannot limit attendance for religious services due to COVID-19

      The ruling was 5-4 with Justice Roberts solo dissenting. It’s the first real impact of Justice Barrett who sided with the conservative majority. Although Roberts in his solo dissent seemed to suggest the order would violate the free exercise clause but that because Cuomo just recently modified the order, the court shouldn’t need to act right now. The 3 liberal justices were much much vocal in their dissent.

      Gorsuch wrote: “As we round out 2020 and face the prospect of entering a second calendar year living in the pandemic’s shadow, that rationale has expired according to its own terms,” Gorsuch wrote. “Even if the Constitution has taken a holiday during this pandemic, it cannot become a sabbatical. Rather than apply a nonbinding and expired concurrence … courts must resume applying the Free Exercise Clause.”

      “We may not shelter in place when the Constitution is under attack. Things never go well when we do,” Gorsuch warned.

      Sotomayor wrote in dissent: “Unlike religious services … bike repair shops and liquor stores generally do not feature customers gathering inside to sing and speak together for an hour or more at a time,” she wrote. “Justices of this Court play a deadly game in second guessing the expert judgment of health officials about the environments in which a contagious virus, now infecting a million Americans each week, spreads most easily.”

      More than anything. The contentious language in this ruling shows the political division in America is quite reflected in the justices of the court. As conservatives focus on the Constitutional rights and individual liberties, the liberals focus of collective safety and following doctors. It is a debate that will likely go on in society long after the pandemic is over.

      Well, so much for managing the spread – I expect it will have impacts elsewhere.

      We’ll be left with common sense which unfortunately isn’t common enough.

      You don’t NEED a church to pray. EVERYONE can pray at home. A church is NOT a necessity. It’s a building.

      This is an idiotic ruling and needs to be overturned.

        Ah, but the point isn’t prayer. The whole point is to shear the flock (contributions) and that is much easier done if you get them all in a room and you can look at them and shame them into contributing. Also the flock gets to gossip and shame any newbies.

      in Fountain County Indiana where covid spread through them like a wildfire!  I don’t have a problem with people wanting to worship some sky god, but spreading a deadly virus throughout the whole county is not religious freedom!

      Responsible churches ,of whatever denomination,are either requesting social distance or offering sermons online.

      The churches that are all about money are the ones who have been crying and carrying on about how persecuted they are.And because she’s a cultist type,Comey Barrett would naturally have sided with them.

      Interesting that John Roberts dissented.

      The religious are allowed to gather in large groups inside their churches to infect each other, then they go out and spread a disease that sickens and kills others?

        This dead-end, pun intended, detour of American fundamentalist Christians have taken started with the movement to teach Creationism in public schools. It should never have been allowed anywhere by the secular government, but it was, and here we are. All those who opposed these fanatics, sitting in our living rooms and learning how they have spread death amongst themselves and their neighbors.

          Like the farther Right a conservative/Republican/DINO is, the less attachment to reality they have. Same thing for religion.
          My view of religion it is pretty much like a superstition and operates the same way. Reality challenged, they are.

      A church has a maximum occupancy limit based on the size of the building, number and location of exits, sprinkler system, etc. And it can be enforced to prevent the faithful from trampling each other when they have to escape a fire. But the Supremes feel themselves qualified to make health safety decisions. Maybe they will exempt churches from having fire exits, extinguishers, etc.
