White House open to a Clinton pardon

The White House isn’t ruling out the possibility of Hillary Clinton receiving a last-minute pardon from President Obama — even though she hasn’t been charged with a crime.

Asked at Wednesday’s press briefing whether Obama had considered utilizing his unique executive power, press secretary Josh Earnest was cryptic.

“The president has offered clemency to a substantial number of Americans who were previously serving time in federal prisons,” Earnest said.

“And we didn’t talk in advance about the president’s plans to offer clemency to any of those individuals and that’s because we don’t talk about the president’s thinking, particularly with respect to any specific cases that may apply to pardons or commutations,” he added.

          22. They're all 3 in cahoots..

But I doubt if it would be legal if he partdoned her proactively. or if it turns out they are co-conspirators of any kind

        28. Obama's legacy will be known for

propping her up for the presidency run of 2016 soon after she conceded to him during the primary of 2008 and if he follows thru, one of his last acts as president to pardon her before Jan 20, 2017. I’ll view this as Obama’s retirement package (in secret of course) promised to him (by Billary, Inc) once he leaves DC.

        30. Clinton cannot plead the 5th amendment if she accepts pardon

Remember, Dur Chimpfuhrer did not pardon anyone on the way out.  He couldn’t.  Darth Cheney and Chimpy would have left their butt’s hanging over the fence if the criminals in their administration were forced to talk under oath and could not take the 5th.  Say what you want about Obama, but do you think he trusts Clinton enough to give her a get-out-0f-jail-free card if it means she has to squeal under oath?

      2. He would do better to let her go to Qatar and cancel her passport enroute.

This “pardon” idea would be a good way to end up on charges of treason himself.

Obama promised a lot of transparency. It finally showed up.--downwinder

      4. IIRC the procedure is for a pardon to be sought

And then there’s a review. This relates to why Clinton’s pardon of Marc Rich looked bad and caused controversy.

      https://en.wikipedia.org/wiki/Marc_Rich#U.S._indictment_and_pardon

On January 20, 2001, hours before leaving office, U.S. President Bill Clinton granted Rich a highly controversial presidential pardon. Several of Clinton’s strongest supporters distanced themselves from the decision.[23] Former President Jimmy Carter, a fellow Democrat, said, “I don’t think there is any doubt that some of the factors in his pardon were attributable to his large gifts. In my opinion, that was disgraceful.”[24] Clinton himself later expressed regret for issuing the pardon, saying that “it wasn’t worth the damage to my reputation.”[9]

Clinton’s critics alleged that Rich’s pardon had been bought, as Denise Rich had given more than $1 million[25] to Clinton’s political party (the Democratic Party), including more than $100,000 to the Senate campaign of the president’s wife, Hillary Rodham Clinton, and $450,000 to the Clinton Library foundation during Clinton’s time in office.[21]

Clinton also cited clemency pleas he had received from Israeli government officials, including then-Prime Minister Ehud Barak. Rich had made substantial donations to Israeli charitable foundations over the years, and many senior Israeli officials, such as Shimon Peres and Ehud Olmert, argued on his behalf behind the scenes.[26] Speculation about another rationale for Rich’s pardon involved his alleged involvement with the Israeli intelligence community.[27][28] Rich reluctantly acknowledged in interviews with his biographer, Daniel Ammann, that he had assisted the Mossad, Israel’s intelligence service,[4][13] a claim that Ammann said was confirmed by a former Israeli intelligence officer.[12] According to Ammann, Rich had helped finance the Mossad’s operations and had supplied Israel with strategic amounts of Iranian oil through a secret oil pipeline.[4] The aide to Rich who had persuaded Denise Rich to personally ask President Clinton to review Rich’s pardon request was a former chief of the Mossad, Avner Azulay.[22][29] Another former Mossad chief, Shabtai Shavit, had also urged Clinton to pardon Rich,[30] whom he said had routinely allowed intelligence agents to use his offices around the world.[17]

Federal Prosecutor Mary Jo White was appointed to investigate Clinton’s last-minute pardon of Rich.[31] She stepped down before the investigation was finished and was replaced by James Comey, who was critical of Clinton’s pardons and of then-Deputy Attorney General Eric Holder’s pardon recommendation.[32] Rich’s lawyer, Jack Quinn, had previously been Clinton’s White House Counsel and chief of staff to Clinton’s Vice President, Al Gore, and had had a close relationship with Holder.[22] According to Quinn, Holder had advised that standard procedures be bypassed and the pardon petition be submitted directly to the White House.[33][Notes 2] Congressional investigations were also launched. Clinton’s top advisors, Chief of Staff John Podesta, White House Counsel Beth Nolan, and advisor Bruce Lindsey, testified that nearly all of the White House staff advising the president on the pardon request had urged Clinton to not grant Rich a pardon.[29] Federal investigators ultimately found no evidence of criminal activity.[30]

        17. he may have to do it to protect his own crimes. but she's not 'charged' for any

thing yet.  Some say that was why Comey let go of the second email review so Clinton Foundation could go forward and would take too long for Obama to pardon if anything came of it.

          19. I believe these pardons may be preemptively granted

so it wouldn’t actually be necessary that she be charged with something first.

In fact, I believe the plan may have been mutual pardons.  Obama pardons her, then after she is elected, viola, she pardons him, and only the citizens get screwed.  Of course Trump’s election threw a yuge spanner into that machine, so I assume that the tit for tat pardon scheme is now off the table and they’re both on their own.

Right now, I’m strongly in the “lock her up” camp.  But I’m also realistic enough to believe that if she just quietly slinks off into the sunset, Trump won’t pursue any criminal charges against her.

They can still use it to fund allies to avoid prosecution.

As long as they can keep those that would try to prosecute them in a partisan box they feel safe.

            27. Yep – under ex parte Garland.

But the sticky bit is that the ruling said (paraphrasing) that the President could pardon anytime after the commission of a crime, even if charges haven’t been filed.

            ex parte Garland

Obama can pardon her, but in doing so he is saying – legally – that she committed the crimes that Comey said she didn’t commit.

He’ll need to pardon Comey and Lynch and probably half of the Justice Department; anyone who signed on or suggested that Clinton’s actions didn’t rise to the level of a crime.

          31. Clinton pardon does not protect his own crimes

Once pardoned, you cannot plead the 5th and can be compelled to testify under oath under penalty of law.

      9. Name one thing Ford is remembered

for besides Nixon’s pardon. Fuck Obama and his republican ways. This will be his legacy. Frankly, he’s inviting armaggedon into his life with this.

I personally think a court challenge to this pardon process which is intended by the founders to right wrongs, not cover up crimes.

      11. Doesn't she have to be charged with something first?

I wouldn’t put it past Lynch to indict her on as many charges as she can conjure up just so she can open the door for a blanket pardon on all charges.

Their filth and corruption is deep and far-reaching. They won’t stop just because she lost the election.

        32. Sorry, but you must be reading that fake news

Nixon was given a blank pardon and there was no court involved.  But, of course, the 18 minute gap and every reference to the “Bay of Pigs Thing” was really about the JFK assassination.  If the truth came out about Watergate burglary, that it was about finding out what Democrats knew about the assassination of a popular Democratic President, people would have been in the streets and not just fighting the Viet Nam war/Military Industrial Complex.  We have been a banana republic since the coup of 1963.
